Breckenridge Short-Term Rental Restrictions & Zoning Guide

Breckenridge Short-Term Rental Zoning Information

If you are considering buying a property in Breckenridge, Colorado with the intention of using it as a short-term rental (STR), understanding the town’s short-term rental zoning regulations is critical. Breckenridge STR rules directly determine whether a property is eligible for a short-term rental license, how many licenses are available in each area, and the likelihood of obtaining a license now or in the future.

Breckenridge regulates short-term rentals through a license cap system based on zoning, meaning not all homes or condos can be used for nightly rentals. These regulations have a significant impact on investment strategy, rental income potential, and long-term property value, making zoning one of the most important factors to evaluate before purchasing.

Background on Breckenridge Short-Term Rental Regulations

In the fall of 2021, the Breckenridge Town Council adopted an ordinance that capped the total number of non-resort short-term rental licenses at 2,200. This decision effectively paused the issuance of new STR licenses for many residential properties outside of hotel- and resort-style developments.

To better understand the impacts on housing availability, tourism, and the local economy, the town convened the Tourism Overlay Task Force. Following its findings, the Town Council approved a revised ordinance in August 2022, which went into effect on September 27, 2022.

This updated ordinance established four distinct short-term rental zones in Breckenridge, each with its own license limits, waitlist rules, and eligibility requirements:

  • Zone 1

  • Zone 2

  • Zone 3

  • Resort Zone

Each zone functions differently, and understanding these distinctions is essential for buyers, investors, and second homeowners evaluating short-term rental potential in Breckenridge.

Below is a detailed breakdown of each Breckenridge short-term rental zone, including license caps, waitlist status, and what buyers should realistically expect when purchasing property in each area.

Resort Zone | Breckenridge Resort Zone: Short-Term Rental Licensing Overview

The Resort Zone in Breckenridge, Colorado includes properties that operate in a hotel- or resort-style setting. These properties typically offer on-site management, front-desk or concierge services, and housekeeping, and are specifically designed to support short-term rental activity.

The Town of Breckenridge allows a maximum of 1,816 short-term rental licenses in the Resort Zone, the highest license allocation of any zone. These licenses are purpose-built for nightly rentals and are not subject to the same neighborhood-preservation limitations found in residential zones.

As of January 20, 2026, there is no waitlist for the Resort Zone, and licenses remain available to qualifying properties. Because of the operational structure and zoning intent, this zone offers the clearest and most reliable path to short-term rental use in Breckenridge.

The Resort Zone is best suited for buyers seeking to maximize short-term rental income with the fewest zoning-related restrictions, particularly those looking for a professionally managed, turnkey rental property.

Zone 1 | Breckenridge Short-Term Rental Zone 1: Licensing Overview & Availability

Zone 1 in Breckenridge, Colorado is designed to support tourism while maintaining balance within surrounding neighborhoods. This zone includes many of the town’s core lodging areas and is the most accommodating zone for short-term rentals (STRs).

The Town of Breckenridge allows a maximum of 1,680 short-term rental licenses in Zone 1. While the zone is subject to a cap, licenses may become available through natural attrition, creating opportunities for new owners to obtain a license.

As of January 20, 2026, there is no waitlist for Zone 1, and there are approximately 467 short-term rental licenses currently available. This makes Zone 1 the most accessible option in Breckenridge for buyers seeking nightly rental potential.

Because of the greater availability and clearer path to licensing, Zone 1 is best suited for investors, second homeowners, and buyers seeking short-term rental income, provided the property otherwise qualifies under town regulations.

Zone 2 | Breckenridge Short-Term Rental Zone 2: Restrictions & Waitlist Update

Zone 2 in Breckenridge, Colorado consists primarily of established residential neighborhoods with a strong full-time and local owner presence. Short-term rentals (STRs) are highly restricted in this zone in order to preserve neighborhood character.

The Town of Breckenridge allows a maximum of 130 short-term rental licenses in Zone 2, and all licenses are currently allocated. No new licenses are being issued at this time.

Prospective buyers may place their name on the Zone 2 STR waitlist, as licenses may become available only if:

  • A current license is not renewed
  • A property with a license is sold (licenses do not transfer with a sale)

As of January 20, 2026, there are 22 applicants on the Zone 2 short-term rental waitlist.

Because of these limitations, buyers considering property in Zone 2 should plan for personal use or long-term rental income, rather than relying on short-term rental potential. While future licensing is possible, timing is uncertain and should not be assumed as part of an investment strategy.

If you are considering buying in Breckenridge and want to understand which subdivisions fall within Zone 2, how the waitlist works, or whether a property aligns with your goals, contact me to discuss current opportunities and zoning-specific strategies.

Zone 3 | Breckenridge Short-Term Rental Zone 3: Restrictions & Waitlist Update

Zone 3 in Breckenridge, Colorado is made up primarily of long-term residential neighborhoods intended to support full-time residents and second homeowners. Short-term rentals (STRs) are significantly restricted in this zone under the Town of Breckenridge’s licensing program.

Zone 3 allows for a maximum of 390 short-term rental licenses. However, there are currently 1,068 active STR licenses, meaning the zone is substantially over the established cap. As a result, no new licenses are being issued at this time.

Prospective buyers may add their name to the Zone 3 STR waitlist, but additional licenses will not become available until more than 670 existing licenses are eliminated. Licenses may be eliminated if:

  • A current license is not renewed
  • A property with a license is sold (licenses do not transfer with a sale)

As of January 20, 2026, there are 32 applicants on the Zone 3 short-term rental waitlist.

Given the magnitude of the overage and the uncertainty surrounding future license availability, properties in Zone 3 are best suited for full-time residents or second homeowners with no expectation of nightly rental income. Buyers should not factor short-term rental potential into their purchase or investment analysis for this zone.

If you are evaluating properties in Breckenridge and want to understand which subdivisions fall within Zone 3, how the waitlist functions, or how zoning impacts long-term value and use, contact me to discuss your options and strategy.
